Akasha Herbs Affiliate Program Terms & Conditions
1. Agreement Overview
By participating in the Akasha Herbs Affiliate Program, you agree to the following Terms and Conditions, which outline the relationship between Akasha Herbs ("we," "our," "us") and you, the affiliate ("Affiliate," "you").
2. Affiliate Program Participation
As an affiliate, you are authorized to promote Akasha Herbs products and services on your website, blog, social media, or other platforms. In exchange for qualifying sales generated through your referral links, you will earn commission as specified in our affiliate offer.
3. Commission Rate
- The standard commission rate is 10% of the sale price, unless otherwise noted in the specific affiliate offer or agreement.
- If there is a change in the commission rate, you will be notified, and a two-week notice period will be given before the new rate applies.
4. Payout Terms
- Payout Schedule: Affiliate payouts will be made within 60 business days of the sale. This time frame allows us to ensure that no chargebacks or returns have occurred and that the sale is confirmed as legitimate.
- Payment Method: Payments will be made through PayPal or Bank Transfer, unless otherwise noted in the specific agreement or offer.
- Minimum Payout Threshold: You must have a minimum account balance of $7.77 to request a payout.
- Payment Details: You are responsible for ensuring that your PayPal or bank account details are accurate and up to date to receive payments.
- Fees: Akasha Herbs is not responsible for any bank or PayPal fees incurred during the payment process, including transaction fees or exchange rate costs.
5. Chargebacks, Refunds, and Cancellations
- Chargebacks & Returns: If a customer issues a chargeback or return, the commission for the sale will be reversed. This may affect the amount paid in your next payout.
- Sale Validity: We reserve the right to withhold commissions for sales that are found to be fraudulent, canceled, or disputed by the customer.
6. Affiliate Responsibilities
- Promotions: Affiliates must promote Akasha Herbs products and services in a manner consistent with Akasha Herbs’ values, brand image, and legal requirements.
- Personal Experiences: Affiliates may share their personal experiences with Akasha Herbs products, but may not make any health claims about the products, such as suggesting that the products can cure, treat, or prevent any medical condition.
- FTC Guidelines: Affiliates must adhere to the Federal Trade Commission (FTC) guidelines, which require that all endorsements and testimonials on your site or social media be truthful and not misleading. This means you must clearly disclose that you are an affiliate and may receive compensation for any purchases made through your referral links. Additionally, you must ensure that any testimonials or endorsements accurately reflect your personal experience and do not make unsupported claims about the effects of the products. 7. Termination and Right to Discontinue
- Program Termination: Akasha Herbs reserves the right to stop or discontinue the affiliate program at any time, with or without notice, for any reason.
- Affiliate Account Cancellation: Akasha Herbs reserves the right to cancel your affiliate account for any reason, including but not limited to, breaking any terms outlined in this agreement. Violations of the terms may result in the immediate termination of your affiliate status and the forfeiture of any unpaid commissions.
- Termination by Affiliate: Either party may terminate this agreement at any time, with or without cause. In the event of termination, commissions will still be paid for valid sales made before termination. However, commissions for any sales made after termination will not be paid.
8. Modifications
We reserve the right to modify or update these Terms and Conditions at any time. All changes will be communicated to Affiliates, and continued participation in the program will constitute acceptance of the revised terms.
9. Limitation of Liability
Akasha Herbs will not be liable for any damages arising from participation in the affiliate program, including but not limited to, loss of profits, business interruption, or indirect damages.
10. Governing Law
These Terms and Conditions are governed by the laws of Miami Dad County, in Miami Florida, without regard to its conflict of laws provisions.
Arbitration: By participating in the Affiliate Program, you waive your right to a trial, and any legal issues, disputes, or claims arising out of or relating to these Terms and Conditions or your participation in the program must be resolved through binding arbitration in Miami, Florida. Arbitration will be conducted in accordance with the rules of the American Arbitration Association. The decision of the arbitrator will be final and binding.
11. Legal Fees and Indemnification
By participating in the Akasha Herbs Affiliate Program, you agree to indemnify and hold harmless Akasha Herbs, its affiliates, employees, and agents from any and all claims, liabilities, damages, losses, costs, or expenses, including legal fees, arising out of or related to your participation in the program, your promotion of Akasha Herbs products, or any breach of these Terms and Conditions.
You agree to cover all legal fees incurred by Akasha Herbs in the event of any legal issues arising from your actions or violations of these Terms.
