Always consult an appropriately qualified healthcare professional regarding questions about your health and before beginning a dietary supplement, particularly if you:
- Are pregnant or breastfeeding

3. FDA Disclaimer
Where applicable to statements concerning dietary supplement structure or function:
These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.
4. Individual Results
Individual experiences with dietary supplements vary. Factors including age, diet, lifestyle, genetics, health status, medications, dosage, consistency of use, and other individual circumstances may affect a person's experience.
Akasha does not guarantee any particular health, wellness, physical, psychological, sexual, performance, cleansing, detoxification, weight-related, or other outcome from using a product.
Testimonials, reviews, photographs, stories, or experiences shared by customers describe individual experiences and should not be interpreted as guarantees that another person will experience the same results.
5. Product Information
We make reasonable efforts to provide accurate product descriptions, ingredient information, photographs, pricing, and other website information.
However, packaging, formulas, ingredient sources, appearance, availability, and other product characteristics may change where permitted by law.
You should always review the actual product label, ingredient list, directions, warnings, and packaging before use.
If website information conflicts with the current physical product label, stop use if appropriate and contact us for clarification.
6. Allergies, Interactions, and Contraindications
Botanical and dietary ingredients can cause allergic reactions, sensitivities, side effects, or interactions with medications, supplements, foods, or medical conditions.
You are responsible for reviewing ingredient lists and warnings before using a product.
Consult an appropriately qualified healthcare professional regarding possible contraindications or interactions.
Discontinue use and seek appropriate medical attention if you experience a serious or unexpected adverse reaction.
7. Proper Product Use
Products must be used according to their labels and instructions.
You agree not to intentionally misuse our products or use them in a manner inconsistent with warnings, directions, applicable laws, or reasonable safety precautions.
Do not exceed the recommended serving unless directed by an appropriately qualified healthcare professional.
Akasha is not responsible for consequences resulting from intentional misuse, unauthorized modification, improper storage, use contrary to instructions, combining products or substances contrary to professional advice, or failure to consider known allergies, contraindications, or medication interactions, except to the extent liability cannot legally be excluded.
8. Educational Content
Articles, ingredient profiles, traditional-use discussions, research summaries, botanical information, quizzes, videos, social media content, and other educational materials are provided for general informational purposes.
References to historical or traditional botanical practices do not establish that a product has been scientifically proven to produce a particular medical outcome.
Scientific research evolves, and summaries appearing on our website may not reflect every study, interpretation, limitation, or subsequent development.
Nothing on the website establishes a physician-patient, clinician-patient, therapist-patient, pharmacist-patient, or other healthcare-provider relationship.
9. Website Quizzes and Recommendations
Any questionnaire, quiz, recommendation engine, artificial intelligence feature, or personalized website experience provided by Akasha is intended to assist customers in exploring our products and educational materials.
Results are not medical diagnoses or individualized medical advice.
You remain responsible for determining whether a product is appropriate for you and should consult a healthcare professional when appropriate.
10. Orders
All orders are subject to acceptance and availability.
We reserve the right, where permitted by law, to:
- Refuse or cancel an order
- Limit quantities
- Correct pricing or description errors
- Prevent suspected fraud or unauthorized transactions
- Discontinue products
- Restrict resale or unauthorized distribution
If we cancel an order after payment has been collected, we will provide an appropriate refund for the canceled portion.
11. Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable taxes, shipping charges, and other fees may be added during checkout.
You authorize us and our payment providers to charge the payment method you submit for your order and applicable charges disclosed at checkout.
We may correct inadvertent pricing errors as permitted by law.
12. Shipping
Shipping estimates are estimates rather than guarantees unless expressly stated otherwise.
Delivery may be affected by carriers, weather, holidays, incorrect addresses, supply conditions, or circumstances beyond our reasonable control.
Risk of loss and title will transfer as provided by applicable law and our shipping arrangements.
Customers are responsible for providing an accurate and complete delivery address.
13. Returns and Refunds
Purchases are subject to the Akasha Returns & Refund Policy in effect at the time of purchase.
Any separate Returns & Refund Policy incorporated into the website forms part of these Terms.
Nothing in these Terms eliminates consumer rights that cannot legally be waived.
14. Promotions and Discount Codes
Promotional offers may be subject to separate conditions.
Unless otherwise stated, promotional codes:
- Have no cash value
- Cannot be combined with other offers
- May be limited to one use per customer

15. Reviews and User Content
If you submit a review, testimonial, photograph, comment, or other content to Akasha, you represent that you have the right to submit it and that it is truthful based on your genuine experience.
You may not submit unlawful, defamatory, fraudulent, misleading, infringing, threatening, obscene, or malicious content.
To the extent permitted by law, when you voluntarily submit content for publication, you grant Akasha a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, adapt, and use that content in connection with our website, products, advertising, and marketing, subject to applicable privacy and advertising laws.
We may moderate or remove content where permitted by law, but we will not condition or suppress legitimate consumer reviews merely because they express an unfavorable opinion in violation of applicable law.
16. Intellectual Property
The Akasha Herbs name, logos, product names, packaging, website design, photographs, graphics, illustrations, videos, written content, product descriptions, educational materials, and other original materials are owned by or licensed to Akasha Herbs LLC and are protected by applicable intellectual-property laws.
You may not copy, reproduce, modify, republish, distribute, sell, scrape, commercially exploit, or create derivative works from protected Akasha materials without prior written authorization, except as permitted by law.
Nothing in these Terms transfers ownership of Akasha intellectual property to you.
17. Prohibited Uses
You may not use our website to:
- Violate applicable law
- Commit or facilitate fraud
- Interfere with website security
- Introduce malicious software
- Attempt unauthorized access
- Scrape or harvest information through unauthorized automated means
- Impersonate another person
- Infringe intellectual-property rights
- Resell products in violation of an applicable authorized-reseller agreement
- Make false or misleading representations regarding Akasha or its products
- Use our content commercially without authorization
18. Third-Party Services
Our website may integrate with or link to third-party services, including payment processors, social media platforms, shipping providers, analytics services, or other websites.
Akasha does not control all third-party services and is not responsible for their independent acts, omissions, terms, privacy practices, availability, or content.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website, content, and services are provided on an 'as is' and 'as available' basis.
Akasha disclaims warranties not expressly provided by law or expressly made in writing by Akasha, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such warranties may legally be disclaimed.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Akasha Herbs LLC and its owners, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to the website, content, services, or products where such damages may legally be excluded.
Any limitation of liability is subject to applicable law.
Nothing in these Terms is intended to limit liability that cannot legally be limited or excluded.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Akasha Herbs LLC and its officers, owners, employees, affiliates, contractors, and agents from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the website, material violation of these Terms, infringement of third-party rights, or intentional misuse of our services.
This provision does not require you to indemnify Akasha for liability caused by Akasha where such indemnification is prohibited by law.
22. Force Majeure
Akasha will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fires, epidemics, governmental actions, transportation interruptions, carrier failures, labor disruptions, internet or infrastructure failures, supply shortages, or similar events, subject to applicable consumer law.
23. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or non-waivable consumer protections provide otherwise.
24. Dispute Resolution and Arbitration
Please read this section carefully. It may affect your legal rights.
Before initiating formal proceedings, you and Akasha agree to make a reasonable good-faith attempt to resolve a dispute informally by written notice.
Except for claims eligible for small claims court and claims seeking appropriate injunctive relief concerning intellectual-property rights, and except where prohibited by law, disputes arising from these Terms, the website, or a transaction with Akasha may be resolved through binding individual arbitration rather than a court proceeding.
Arbitration will be conducted pursuant to applicable federal law and the rules of a nationally recognized arbitration provider identified in the applicable dispute notice or arbitration agreement.
To the fullest extent permitted by law, disputes subject to arbitration will be conducted on an individual basis and not as a class, collective, consolidated, or representative action.
If any portion of this arbitration provision is found unenforceable, the remaining portions will continue to apply to the extent legally permitted.
Because arbitration and class-action provisions have significant legal consequences and requirements can vary, Akasha should obtain legal review of this section before relying upon or enforcing it.
25. Severability
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed where appropriate, without affecting the validity of the remaining provisions.
26. No Waiver
Failure by Akasha to enforce a provision of these Terms does not waive our right to enforce that provision later.
27. Changes to These Terms
We may update these Terms periodically.
Changes will become effective when posted or at another time stated in the updated Terms, subject to applicable law.
Material changes will not be applied retroactively where doing so would be prohibited by law.
28. Entire Agreement
These Terms, together with our Privacy Policy and any policies expressly incorporated by reference, constitute the agreement between you and Akasha concerning your use of the website and applicable transactions, except where separate written terms apply.
